1. Acceptance of Terms
By accessing or using the HopeBridge Foundation website (the “Site”), you agree to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree to all of these terms, please do not use the Site. We reserve the right to update or modify these terms at any time without prior notice. Your continued use of the Site after any changes constitutes acceptance of the new terms.
2. Eligibility
You must be at least 18 years old to make a donation or register for an account. If you are under 18, you may only use the Site with the involvement of a parent or guardian. By using the Site, you represent that you meet these eligibility requirements.
3. Donations & Payment Terms
All donations made to HopeBridge Foundation are voluntary and non‑refundable unless an error has been made by our payment processor. We accept donations via credit card, PayPal, bank transfer, and check. Your payment information is processed securely by third‑party payment gateways (Stripe, PayPal). We do not store your full credit card details on our servers. All transactions are in US dollars unless otherwise stated. You will receive an automatic email receipt that serves as your official tax record.
4. Recurring Donations
If you choose a monthly recurring donation, your designated amount will be charged automatically on the same day each month. You may cancel your recurring donation at any time by emailing donors@hopebridge.org or by calling our donor support line. Cancellation requests received at least 5 business days before the next billing date will prevent future charges.
5. Use of Website
You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else’s use of the Site. Prohibited behaviour includes but is not limited to:
- Attempting to gain unauthorised access to any part of the Site.
- Uploading viruses, malware, or other harmful code.
- Harassing, abusing, or threatening others.
- Engaging in any activity that disrupts or interferes with the Site’s functionality.
6. Intellectual Property
All content on this Site – including text, graphics, logos, images, video clips, and software – is the property of HopeBridge Foundation or its content suppliers and is protected by international copyright laws. You may not reproduce, distribute, modify, or create derivative works of any material on this Site without our prior written consent.
7. User Accounts
Certain features may require you to create an account (e.g., for recurring donations or volunteer portals). You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account. HopeBridge Foundation is not liable for any loss or damage arising from your failure to protect your account information.
8. Third‑Party Links
The Site may contain links to external websites or services that are not owned or controlled by HopeBridge Foundation. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third‑party sites. You acknowledge and agree that we shall not be liable for any damage or loss caused by your use of such sites.
9. Limitation of Liability
To the fullest extent permitted by law, HopeBridge Foundation, its directors, employees, and volunteers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site, even if advised of the possibility of such damages. In no event shall our total liability exceed the amount you have paid to us in the past twelve months.
10. Indemnification
You agree to indemnify, defend, and hold harmless HopeBridge Foundation, its officers, directors, employees, and volunteers from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to your violation of these Terms, your use of the Site, or your infringement of any third‑party rights.
11. Termination
We reserve the right to suspend or terminate your access to the Site at any time, without notice, for any reason, including but not limited to your breach of these Terms. Upon termination, all provisions of these Terms that by their nature should survive termination shall survive (including intellectual property, limitation of liability, and indemnification).
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. Any legal action arising out of or related to these Terms shall be brought exclusively in the state or federal courts located in New York County, New York. You consent to the personal jurisdiction of such courts.
13. Changes to These Terms
We may revise these Terms from time to time. The most current version will always be posted on this page with the “Last Updated” date. By continuing to access or use the Site after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Site.
14. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and HopeBridge Foundation regarding your use of the Site, superseding any prior agreements or understandings.
